How to handle an uncontested divorce yourself

An uncontested divorce can be done without a lawyer if you agree with your spouse on the key points. The preparation of the documents needs care.

   Agree with your spouse

   Confirm you want an uncontested divorce: married at least a year, living apart more than six months.

   Settle the children first

   If there are minor children, the guardianship court must approve custody and maintenance before the divorce.

   Prepare the agreements

   Draft the property settlement and, where relevant, the housing arrangement, in writing and signed.

   File the joint petition

   Both spouses file the petition with the district court and pay the 2,000 CZK fee.

   Attend the hearing

   The court confirms the agreement and grants the divorce, usually in a single short hearing.
