What can I do if my employer did not pay my wages?
You have the right to your wages plus statutory late interest. Non-payment of wages is a serious breach that lets you terminate the employment immediately. Send a written demand first, then you can sue and, if the employer is insolvent, claim from the Labour Office wage guarantee scheme.
Under the Labour Code (Act No. 262/2006) wages are due on the agreed payday, at the latest the last day of the following month. Late payment entitles you to interest on the arrears.
If wages are more than 15 days overdue, you may terminate the employment immediately under Section 56 and are entitled to compensation equal to the notice period.
If the employer becomes insolvent, the Labour Office pays outstanding wages for a limited period under the wage guarantee scheme (Act No. 118/2000).
