How do I get my rental security deposit back?
The landlord must return the deposit when the lease ends, minus any justified deductions for unpaid rent or damage beyond normal wear. Payment is due without undue delay, at the latest one month after you hand back the flat and settle claims. Document the flat's condition at handover with photos and a protocol.
The Civil Code caps a security deposit at three months' rent and requires it to be returned at the end of the lease, with interest where agreed.
The landlord may deduct only justified amounts, such as unpaid rent or the cost of repairing damage that goes beyond ordinary wear and tear.
A dated handover protocol signed by both parties, plus photographs, is the best protection. If the landlord withholds the deposit without cause, you can demand it in writing and then sue.
