How do I file a lawsuit in a Czech court?
File a written statement of claim with the competent court. It must identify the parties, describe the facts, state the legal basis, list the evidence and set out exactly what you ask the court to order. You pay a court fee, usually 5 percent of the amount claimed, with a minimum of 1,000 CZK.
A statement of claim (žaloba) is filed in writing with the court that has subject-matter and territorial jurisdiction. The general venue is the defendant's place of residence or registered office.
The claim must contain the parties' details, a description of the facts, the legal reasoning, the exact relief sought (the petit) and the evidence relied on.
The court fee is set by the Court Fees Act. For a monetary claim it is 5 percent of the value, minimum 1,000 CZK, paid after the court's request. Forms and information are available on justice.cz.
